JUDGE GERSHON IGNORES SEPERATION OF POWERS

Two congressmen called on the Justice Department Monday to appeal a recent decision in federal district court that found the government’s move to cut off funding to ACORN was unconstitutional.

In a letter to Attorney General Eric Holder, U.S. Reps. Lamar Smith, R-Texas, and Darrell Issa, R-Calif., described the Dec. 11 decision by Judge Nina Gershon as “preposterous.”

“The district court’s decision is troubling in many respects, but most significantly, if allowed to stand, it would effectively excise from the Constitution Congress’ express Spending Clause power to refuse to appropriate federal funds to an organization that has shown itself likely to misuse those funds in the future,” the letter reads. “Such a conclusion is nothing short of preposterous.”

Gershon, who issued a preliminary injunction against the government, ruled it was in the public interest for ACORN to continue receiving federal funding.

“They have been singled out by Congress for punishment that directly and immediately affects their ability to continue to obtain federal funding, in the absence of any judicial, or even administrative, process adjudicating guilt,” Gershon said in her ruling.

In its lawsuit, ACORN, or the Association of Community Organizations for Reform Now, claimed Congress’ decision to ban funding to the group was unconstitutional because it targeted an individual organization.

The law that stopped ACORN’s federal funding had been set to expire or be extended for a second time on Dec. 18.

Gershon’s ruling, meanwhile, was the result of “left-wing activist judge,” said Issa, adding that ACORN is not fit to receive federal funds.

“This left-wing activist judge is setting a dangerous precedent that left-wing political organizations plagued by criminal accusations have a constitutional entitlement to taxpayer dollars,” Issa said in a statement released Monday.

Justice Department spokeswoman Beverley Lumpkin told The Associated Press the agency was reviewing Gershon’s decision and declined to comment further.

In a statement, ACORN CEO Bertha Lewis said the ruling was a “victory for the constitutional rights” of all Americans.

IF CONGRESS BOTH SIDES AND BOTH PARTIES DONT ACT SOON THEY WILL BECOME A HOUSE OF LORDS. THERE IS AN ASSAULT GOING ON TO THE VERY FABRIC OF OUR REPUBLIC. THE THREE BRANCHES OF GOVERNMENT MUST REMAIN.

Fistgate II: High School Students Given ‘Fisting Kits’ At Kevin Jennings’ 2001 GLSEN Conference

In March 2000 the Gay, Lesbian, and Straight Education Network (GLSEN) organization of Massachusetts held its 10 Year Anniversary GLSEN/Boston conference at Tufts University. This conference was fully supported by the Massachusetts Department of Education, the Safe Schools Program, the Governor’s Commission on Gay and Lesbian Youth, and some of the presenters even received federal money. During the 2000 conference, workshop leaders led a “youth only, ages 14-21″ session that offered lessons in “fisting” a dangerous sexual practice. During another workshop an activist asked 14 year-old students, “Spit or swallow?… Is it rude?” The unbelievable audio clip is posted here. Barack Obama’s “Safe Schools Czar” Kevin Jennings is the founder of GLSEN. He was paid $273,573.96 as its executive director in 2007. Jennings was the keynote speaker at the 2000 GLSEN conference.

WASHINGTONCalifornia Democratic Sen. Barbara Boxer said Monday that abortion-rights foes in the U.S. Senate are showing “a lack of respect” for women by promoting legislation that would limit abortions.

“Please don’t single out women,” Boxer said in a speech on the Senate floor. “What have women done to deserve this? … Why have such a lack of respect for them?”

Boxer made the remarks as the Senate prepared to vote on an amendment by Democratic Sen. Ben Nelson of Nebraska that would prohibit any insurance company from offering plans to cover abortion services if they receive federal subsidies.

In addition, the amendment would block a new government insurance plan from covering abortions except for cases of rape, incest or danger to the life of the mother.

The House attached a similar amendment to its health-care bill last month, and Boxer has emerged as a leader for a group of Democratic women leading the charge to defeat the measure in the Senate.

Nelson and other backers of the legislation say the amendment should be passed because, without it, taxpayer dollars would be used to pay both directly and indirectly for insurance plans that cover abortion.

Boxer said that senators who are supporting the amendment are not trying to limit any medical procedures for men. She said she would not back an amendment to limit Viagra prescriptions to men and that women deserve the same treatment for their reproductive choices.

“All we are saying is please leave it alone,” Boxer said, adding that approval of the amendment would result in the biggest rollback of women’s reproductive rights in three decades.

Joining Boxer, Democratic Sen. Barbara Mikulski of Maryland said Nelson’s amendment was unnecessary and unneeded. She said abortion decisions should be made by patients and doctors, not insurance executives and politicians.

Abortion politics are threatening to derail final passage of a health-care bill, which congressional leaders hope to send to President Barack Obama before the end of the year.

In the House, a group of 40 abortion-rights backers is threatening to vote against the legislation if the abortion-limiting language is not removed by a HouseSenate conference committee.

TOO FUNNY

Alexandria, VA – For the fourteenth straight day, the three broadcast networks have failed to report on the great and growing ClimateGate scandal on their weekday morning or evening news programs.  How to explain this?

Perhaps it is that ABC, NBC and CBS have not yet heard of the story, despite two weeks of non-stop reporting on and discussion of ClimateGate in a whole host of media outlets.

Perhaps the broadcast networks only trust their fellow liberal press outlets, like the New York Times.  Perhaps they don’t realize the Times exhibited journalistic diligence on ClimateGate, with a front page story the day the story broke.  

In the event that ABC News, NBC News and CBS News missed the news, the Media Research Center (MRC) is today rushing each of them a copy of the Times story, in the hopes that armed with this new information, they will finally report a story that has been roiling nearly everywhere else for a fortnight.

So as not to offend the networks’ pro-global warming sensibilities, MRC President Brent Bozell is looking to have the stories delivered by bicycle messenger.

Bozell:

“Ignorance is no excuse under the law, but maybe we should stop criticizing and start showing compassion for NBC, ABC and CBS and their neglect of the huge ClimateGate story.  We are more than happy to help rectify their knowledge deficit – via a network-friendly source and in an as environmentally-friendly a way as possible.

“We think that once the networks read the story of ClimateGate in their vaunted New York Times, they’ll feel compelled to report it themselves.  

“We very much look forward to seeing the fruits of their labor.”
